Holbergsamtalen med Cass Sunstein
Under Holberguken i juni 2018 møtte Anine Kierulf Holbergprisvinner Cass Sunstein til samtale om hans forskning, hans bakgrunn og om hvordan han har jobbet for å fremme rettighetsidealer som frihet, verdighet, likhet, selvstyre og rettssikkerhet.
Harvard University-professoren og tidligere administrator i avdeling for informasjon og regulering i Det hvite hus, Cass Sunstein, snakket om en rekke emner med Anine Kierulf, som er fagdirektør ved Norges institusjon for menneskerettigheter. Sunstein kunne dele av sin innsikt i blant annet generell rettsvitenskap.
- The fact that we are safe, usually, that has to do with law, even if law is never triggered.
Sunstein fortalte også hva som gjorde at han er interessert i forvaltningsrett spesielt.
- Some of the administrative law questions are constitutional questions, some of them are not constitutional, but the constitution looms in the background. I got hooked on administrative law partly because it had issues about fairness and equality all over it.
Engasjementet hans for forvaltningsrett er noe av det som ledet til en jobb i tidligere President Obamas administrasjon, og han delte noen av erfaringene derfra.
- Working in government does not have the same kind of excitement as you can get if you are working on an idea and you are trying to get it right. But [working] in government, I found immensely gratifying. On a day, I got to participate in something that was going to reduce the number of deaths from air pollution in my country by a significant number. I was blessed to participate in that.
Hans innflytelsesrike arbeid med nudging, eller dulting – en form for påvirkning som myndigheter og bedrifter kan utføre uten å begrense menneskers frihet – ble også diskutert, og han forklarte konseptet på enkelt og forståelig vis.
- So think of a GPS-device, which you can ignore, which helps you to get to your preferred destination, and which gives you help. It is a nudge. A GPS-device is completely a nudge, or a reminder, or a disclosure of information. They are preserving your freedom of choice, but nudging you to go in a certain direction. And the idea here is that freedom often needs to be preserved, but the word is too abstract. Life needs to be easier to navigate, and a nudge can help people navigate life.
